a) For merchandise that totals more than $1,000.00 US, a Mexican Customs Agent. b) Be registered as an importer in the Register of Importers issued by the SHCP or contract the services of a Distributor that is registered in the Register c) For certain goods, be registered in the Sectoral Register of Importers. d) Have a commercial invoice that meets the legal requirements for imports. e) Have a certificate of origin issued by the supplier for the merchandise that is required to be imported f) Send the permits, NOMs or authorizations if necessary for the merchandise to be imported g) Pay taxes and import duties.
There are mainly two types for imports or exports: Definitive or Temporary. a) Definitive imports or exports are those in which it is not expected to return the merchandise once imported or exported to its country of origin, for which taxes or duties are paid. A common final import regime is A1. b) Temporary imports or exports are those that are going to be subject to some process and will later be returned to their country of origin. The main programs are Maquiladora and Imex
The fiscal traffic light is a control system of the Mexican Government to verify import and export shipments that enter or leave the country. The system is not random. Several factors determine whether the merchandise to be imported or exported is intensively inspected by the authorities. These factors may be the type of merchandise, the tariff fraction, or the importer or exporter of the merchandise. The process begins once the petition is delivered to the person in charge of the import or export module. The person in charge reads the barcode and registers the petition number in the system of the Ministry of Finance. Immediately, the computer determines whether the shipment continues on its "green" path or requires "red" inspection. In this process, the verifier checks the documentation and thr merchandise presented.
The NOMS are non-tariff regulations for the assurance of international quality standards. In Mexico there are two types: NOM for Labeling or NOM for commercial information or Quality and Specifications. In the labeling NOM, the product must be labeled according to the Standards established for the product to be imported according to its tariff classification. In the case of Quality NOM, a special permit must be granted by SECOFI for its importation after having been approved for importation by an authorized laboratory.
It is a national registry of importers from Mexico. This register is divided into the Register of Importers, which is the general register of importers in the Country, and the Sectoral Register, which is a register in which one must be registered to import products that are sensitive to the country's economy. With the exception of certain products or types of product, it is essential to be registered in this register before being able to carry out any import or export process.
The invoice must include the following information: 1. Name and address of the Provider (No PO Boxes) 2. Provider Telephone 3. Tax ID of the provider 4. Detailed description of the product. Avoid abbreviations or codes. 5. Unit and total price per batch. 6. Origin of the product. 7. All products must have market value. Note: $0.00 is not accepted at customs even if they are samples or gifts. 8. INCOTERM used in the transaction. (It can be indicated in an annex or in the letter of instructions).
The customs value, on which the tax calculation is made, is the sum of the invoice value plus all incremental expenses such as loading and unloading expenses, storage and freight from the moment the product is sent to the customer until the import of the same.
